NFL, Brady want resolution to suspension, lawsuit before season starts

(MyFoxBoston.com) -- Tom Brady has decided that he wants a quick resolution to his lawsuit, and not a lengthy legal fight.

The NFLPA, under guidance from Brady, filed a motion in New York on Friday requesting a pre-motion meeting to try and solve the legal battle with the NFL and Commissioner Roger Goodell by Sept. 4.

Also revealed within the motion is that Brady will not be seeking a temporary restraining order or a preliminary injunction, which would have allowed him to play while the case was heard. The NFL also seems to be on-board in respect to resolving this case sooner rather than later, as NFLPA Attorney Jeffrey Kessler wrote that "the NFL does not oppose this request". This is one of the first items both sides have agreed on in this bizarre case that has now lasted over six months.

Kessler suggested within the motion that the parties argue their cases on Aug. 7 and file the formal paperwork by Aug. 14, which would give Judge Richard Berman three weeks to render a decision by the Sept. 4 deadline.

FOX25 went through the filing with a local attorney. He says what stood out to him is that it appears both sides are on the same page, at least in the filing.

Attorney David Yanetti said, "With training camp in full swing, it's here, on the field where Tom Brady wants to focus his attention. His lawyers said as much in this three-page letter filed Friday in New York."

Yanetti says it's an unusually quick timeline for a federal civil case, but one that both the NFLPA and the NFL seek.

"Both sides are asking for something. The NFL is asking federal court in New York to confirm the suspension where is Brady is asking they vacate the suspension," he said.

Brady's legal team also requested some portions of the filings remained sealed.

This all comes after the deflategate scandal centered around deflated balls allegedly used in the AFC championship game.

The Patriots are set to open the season Sept. 10 against the Steelers at Gillette Stadium, whether or not their franchise quarterback will be under center is unknown, but we seem to be moving closer to an answer.
