'Deflategate' back in court after Brady-Goodell talks fail

Posted: Updated:

NEW YORK (AP/MyFoxBoston.com) — New England Patriots quarterback Tom Brady is heading back to practice after an 11th-hour bid failed to settle the "Deflategate" scandal before it's left in the hands of a federal judge.

Oral arguments before a federal judge will being at 10 a.m. on Wednesday after Brady and NFL Commissioner Roger Goodell joined lawyers a day earlier at an undisclosed New York location to work out a deal. The dispute centers on the legality of the NFL's four-game suspension of Brady after Goodell concluded he conspired with Patriots ball handlers to deflate footballs at January's AFC championship game victory.

Two sources familiar with the legal case say four hours of talks Tuesday failed to reach an agreement. The people, who spoke on condition of anonymity because they were not authorized to speak publicly about the case, said the talks failed.

ESPN has reported that Tom Brady is willing to accept a suspension, but only if it's for not cooperating with the league's investigation. Brady will not agree with the findings of the Wells Report.
