BRISTOL, Mass (
MyFoxBoston.com) The defense team for Aaron Hernandez has filed a motion to suppress evidence that resulted from what they say was an unlawful police interrogation.
Approximately a dozen armed officers approached the former New England Patriots tight end and his fiancee Shayanna Jenkins in his home on June 19, 2013 with a search warrant.
Hernandez, who was not with his attorney at the time of the search, said that he was interrogated and, despite repeatedly deferring all questions to his attorney, was asked questions by investigators regarding the investigation into the death of Odin Lloyd. Hernandez has been charged with murder in that case.
"I felt helpless in the face of the occupation of my house by police," Hernandez said in court documents released Monday. "I was also very concerned about what would happen to my fiance and our baby if I refused to answer their questions."
Information obtained from the interrogation included the location and password of Hernandez's cell phone. The defense team for Hernandez has filed to suppress all evidence that was obtained by information given by the defendant during the search, as Hernandez said he was never given his Miranda warnings and did not feel free to leave at any time.
The defense team for Hernandez has also filed a motion to suppress evidence seized by police in June of 2013 from his apartment in Franklin, saying that the authorities did not have a proper warrant for the search. The warrant "utterly failed" to meet legal standards, according to court documents released on Tuesday.
Jury selection for the Odin Lloyd murder trial will begin in January. Hernandez has also been charged with murder in a 2012 double homicide in Boston.
