BOSTON (
MyFoxBoston.com/AP) -- The jury has come to a decision in the sentencing phase of the Boston Marathon bombing trial and Dzhokhar Tsarnaev is now on death row.
Court action could drag it out for years, but a jury in Boston has sentenced the Boston Marathon bomber to death. The federal execution would be carried out by lethal injection. His lawyers had argued that the 21-year-old should be spared execution because he was under the influence of his older brother. The 2013 attack killed three people and wounded more than 260 others.

SECTION VI: DETERMINATION OF SENTENCE
Based upon consideration of whether the aggravating factor or factors found to exist for each count sufficiently outweigh the mitigating factor or factors found to exist for that count to justify a sentence of death, or, in the absence of a mitigating factor, whether the aggravating factor or factors alone are sufficient to justify a sentence of death:
DEATH: We, jury, unanimously find, for SOME of the capital counts, that the aggravating factor or factors found to exist sufficiently outweigh the mitigating factor or factors found to exist or, in the absence of any mitigating factors, that the aggravating factor or factors are themselves sufficient -- so that death is the appropriate sentence for Dzhokhar Tsarnaev with regard to each of the following capital counts only (identify each count by count number): Counts 4, 5, 9, 10, 14, 15.
