BOSTON (
MyFoxBoston.com) -- The Boston Marathon bombing trial will continue and remain in Boston, Judge George O'Toole ruled Friday.
After weeks of not answering the defense's third motion to move the trial, O'Toole responded Friday afternoon and said his reasons for denying their motion remains the same, and added that the jury selection process, though slow, is thorough.
The judge made his way through close to 20 potential jurors on Friday, one of whom said she used to work with the father of Katherine Russell, Tamerlan Tsarnaev's widow.
Another juror caught many in the courtroom off guard during the afternoon session.
Juror 353, like many others, said he opposed the death penalty. When asked why, however, he did not cite moral or philosophical reasons against the punishment.
"I don't know how many thousands of rounds you shot into that boat. You couldn't kill him then. I'm not going to kill him now," he answered.
Police captured accused Marathon bomber, Dzhokhar Tsarnaev, when he emerged from a boat in Watertown on April 19, 2013. Tsarnaev was sitting just feet away from the juror who made the comment on Friday. He did not react. The juror was allowed to leave the courtroom shortly afterward.
The defense is still awaiting a ruling from the appeals court on their motion to stay jury selection and move the trial out of Boston.
More than 160 people have been individually questioned so far. The number of people the judge has qualified for the jury, however, has not been made public. Jury selection is set to resume Monday morning.
