Florida man pleads not guilty to Cape Cod slaying

BARNSTABLE (AP) - The second of two men charged in connection with a fatal shooting in Yarmouth in 2009 has been held without bail.

Phillip Horton of Apopka, Fla. pleaded not guilty at his arraignment on murder and other charges Wednesday in Barnstable District Court.

The 24-year-old Horton was arrested March 4 by the U.S. Marshals Florida Regional Fugitive Task Force in the parking lot of an Orlando shopping plaza, according to court documents.

Horton's father, 71-year-old William Horton, has also pleaded not guilty in connection with the April 2009 shooting of 24-year-old Joseph Tomaselli Jr.

Prosecutors did not disclose a motive or say what led them to the Hortons.

Phillip Horton's lawyer tells the Cape Cod Times he is still reviewing the facts of the case.
